Biography

Albert is a senior member of the Labor and Employment and Litigation practice groups. He has an extensive appellate practice, representing clients before the New York Supreme Court, New York Court of Appeals, United States Supreme Court, and Federal Courts of Appeals. The cases he has argued have resulted in published decisions striking Louisville’s minimum wage ordinance, rejecting extraterritorial application of the New York Civil Rights Act, limiting a franchisor’s liability for claims arising from franchisee operations, establishing a housing authority’s state agency status, and addressing common law wrongful discharge and defamation law.

Albert serves as Co-Chair of the Firm’s Appellate Practice Team, and is a past Chair of the New York Bar Association’s Appellate Advocacy Section. Albert also represents employers in state and federal courts, defending civil rights, common law, wrongful discharge, and contract claims. He frequently counsels employers on labor and employment issues, and is a past Chair of the New York Bar Association Labor and Employment Law Section.

He’s first- or second-chaired 14 trials or binding arbitrations to conclusion, including jury and bench trials in California federal and state courts, and arbitration hearings before AAA, JAMS and FINRA. He’s taken or defended close to 200 depositions, briefed and argued well over 100 motions (winning the overwhelming majority), and won several appeals in the Ninth Circuit, California Court of Appeal and California Supreme Court. He’s obtained TROs, preliminary injunctions, dismissals without leave to amend and summary judgment for his clients dozens of times.

The majority of his practice is devoted to business trials and appeals, focused on trade secrets, commercial contracts, insurance, bankruptcy, real property, land use, financial services and employment disputes. He has significant experience defending class actions involving antitrust, RICO, ADA/Unruh, UCL (Bus. & Prof. Code § 17200), usury, FDCPA and business torts. Andrew also regularly counsels clients on compliance and pre-litigation strategy in real property and outdoor advertising (billboard law) matters. Always mindful of clients’ bottom line, he’s negotiated numerous settlements, in and out of mediation.
